Privacy and Security
(Effective as of June 1, 2007)

This SquareLoop, Inc. Privacy Policy (“Privacy Policy”) explains how SquareLoop, Inc. (“SquareLoop”) collects and uses information about users of its Handset Software, Server Software and or other software, and related documentation (collectively, the “Messaging Software”). This Privacy Policy applies to the use of the Messaging Software and links in websites specifically devoted to the same. Changes to this Privacy Policy are discussed in the last paragraph of this document. Each time you use the Messaging Software, however, the current version of this Privacy Policy will apply. Accordingly, each time you use the Messaging Software you should check the date of this Privacy Policy (which appears at the top of this document) and review any changes since the last time you used the Messaging Software. All capitalized terms that are not defined in this Agreement shall have the meaning set forth in the SquareLoop Terms of Use Agreement, posted on the website at www.squareloop.com/termsofuse.

 1)     Children  

Children under the age of eighteen (18) must have parental permission to utilize the Messaging Software. Use of the Messaging Software or other system components by children is prohibited in areas where such use is prohibited by law.

2)      Types of Information

a)  Non-Personally-Identifying Information is information that, without the aid of additional information, cannot be directly associated with a specific person or entity (e.g., your computer’s, cell phone’s, or other mobile device’s configuration, the version of the web browser you use or your IP address).

b)  Personally Identifying Information is information such as a name or email address that, without more, can be directly associated with a specific person or entity (e.g., a name or telephone number)

3)     Gathering, Use and Disclosure of Non-Personally-Identifying Information

a)   General. Like other software providers and website operators, SquareLoop gathers from users of its products Non-Personally-Identifying Information of the sort that Web browsers, depending on their settings, may make available. That information includes the user’s Internet Protocol (“IP”) address, operating system and browser type, language preference, the referring site, the date and time of your visit and other related information related to the transmission or receipt of Messages using SquareLoop’s platform or products. SquareLoop analyzes Non–Personally–Identifying Information gathered from users of its products to help it better understand how its products are being used. By identifying patterns and trends in usage, SquareLoop is able to better design its products to improve users’ experiences, both in terms of content and ease of use. From time to time, SquareLoop may also release the Non–Personally–Identifying Information gathered from product users in the aggregate, such as by publishing a report on trends in the usage of its products. Finally, SquareLoop may also use the Non-Personally-Identifying Information to collect fees due for its services.

b)    Cookies.   A “Cookie” is a string of information that a website stores on a user’s computer and that the user’s web browsers make available to that website each time the user submits a query to the site. SquareLoop uses Cookies to help identify and track visitors to its website. It is possible to include Personally-Identifying Information, or references to such information, in cookies, thereby enabling websites to track the online movements of particular individuals. WEBSITE USERS WHO DO NOT WISH TO HAVE WEB COOKIES PLACED ON THEIR COMPUTERS SHOULD SET THEIR BROWSERS TO REFUSE WEB COOKIES BEFORE ACCESSING THE WEBSITE, WITH THE UNDERSTANDING THAT CERTAIN FEATURES OF THE WEBSITE MAY NOT FUNCTION PROPERLY WITHOUT THE AID OF WEB COOKIES. WEBSITE USERS WHO REFUSE WEB COOKIES ASSUME ALL RESPONSIBILITY FOR ANY RESULTING LOSS OF FUNCTIONALITY. 

4)    Gathering, Use and Disclosure of Personally-Identifying Information

SquareLoop collects a range of Personally-Identifying Information from and about users of its products. Much of the Personally–Identifying Information collected by SquareLoop about users is information provided by users themselves at the time they register to download the SquareLoop Messaging Software located on the company’s website or when they provide billing data either directly to SquareLoop or through an intermediary. That information includes each user’s email address and telephone number and may include billing addresses or other billing information. SquareLoop will only use your Personally-Identifying Information to:

a)    notify you when there is a change in your account (e.g., you need a new password);


b)    notify you of additional information relating to your account or the company’s products and   services;

c)    install the Messaging Software on your mobile device or personal computer; and

d)    complete the transactions you have requested, including billing and collections of amounts due to SquareLoop or to an intermediary for such transactions.

e)  Where SquareLoop has collected Personally-Identifying Information, it discloses that information only to those of its employees or agents that need to know that information in order to process it on SquareLoop’s behalf and that have agreed not to disclose it to others. SquareLoop does not rent or sell such information to anyone. Other than to its employees or agents, as described above, SquareLoop discloses such information only when required to do so by law, or when SquareLoop believes in good faith that disclosure is reasonably necessary to protect the property or rights of SquareLoop, members of the SquareLoop community, or the public at large. SquareLoop takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of such information.

5)    Protecting Non-Personally Identifying Information and Personally Identifying Information Stored on your Cell Phone or Other Mobile Device

Most cell phones and hand-held data devices store information in the device memory, or additional memory cards or other mechanism for retaining information. Therefore, before discarding your cell phone or other device, trading it in or giving it away, be sure you remove and retain your memory card(s) and follow the manufacturer’s instructions for deleting all personal information on the device itself (usually instructions can be found in your owner’s manual or on the manufacturers’ website). In addition, use passwords to prevent unauthorized access to your cell phone, hand-held data device, wireless account, email and voicemail. If you write down your passwords or user names, keep the information in a secure location. Do not give your password to any person unless you intend that person to have the same full access and ability to make changes to your account that you have. Passwords should be changed periodically. 

6)      Third Party Websites and Services

Just as SquareLoop has its own Privacy Policy, so do most other website and telecommunications service providers. The content that you send to your cell phone or other mobile device may be located on websites over which SquareLoop exercises no control. Before linking to, accessing or otherwise using the website or services of another entity, you should review that entity’s privacy policy and take those steps necessary to, in your discretion, protect your privacy. 

7)    Surveys

From time to time, SquareLoop may ask subscribers and users to participate in surveys designed to help SquareLoop improve its products. Any Personally-Identifying Information provided to SquareLoop in connection with any survey will be used only in relation to that survey, and will be disclosed to third parties not bound by this Privacy Policy only in Non-Personally-Identifying, aggregated form.

8)      Privacy Policy Changes

SquareLoop may change the Privacy Policy from time to time. Any and all changes will be reflected on this page. When SquareLoop changes this policy in a material way a notice will be posted on the website at www.squareloop.com/privacyIt is your responsibility to ensure that you understand the terms of this Privacy Policy. You should periodically check this page for any changes to the current policy.
